Privacy Policy

Last updated: November 2, 2026

Premiumark Inc. operates FERMATA Ritual and fermataritual.com. This policy explains how we collect, use and disclose personal information when you browse our website, place an order, use our services or contact us. Our store is hosted on Shopify.

1. Scope

In this policy, “we”, “us” and “our” mean Premiumark Inc.; “Services” means our website and related shopping, account and customer-care services. Personal information is information that identifies you or can reasonably be linked to you; it does not include de-identified or aggregated information.

This Privacy Policy explains information handling; it is not, by itself, consent to optional tracking or an agreement to arbitrate. The Terms of Service govern a dispute only where you have validly agreed to them and to the extent the law permits. Nothing restricts a complaint to a regulator.

2. Information we collect

Contact and account information: name, email address, telephone number, billing and delivery addresses, account identifiers and preferences that you provide. Account authentication is handled through the relevant platform; do not send us passwords or verification codes.

Orders and payments: products viewed, saved or added to cart; purchases, returns, exchanges, cancellations and order history. Payment card data is processed by Shopify and payment providers; we receive transaction status and limited card details only. Do not email full card numbers or passwords to us.

Customer-care communications: inquiries, return requests, reviews, product concerns, photographs and batch details. Share only what is necessary; we do not request medical records.

Technical and transaction information: IP address, browser and device details, referral information, requested pages, cart or checkout activity, and records needed to operate, secure and troubleshoot the store. Shopify and payment or security services may use cookies or similar storage as described in Section 7. Any additional tools are addressed in Section 7.

Preferences: preferences you select and product interests reflected in your inquiries or orders. We do not use purchases or browsing to infer a medical diagnosis, health condition or treatment need.

3. Sources

We receive information from you, your authorized representative or a gift purchaser; from Shopify, payment providers, carriers and fulfillment or customer-care providers; and through the technical operation of the store, including the analytics and advertising technologies described in Section 7. Give us another person’s details only when you are authorized to do so.

4. How we use information

To accept and fulfill orders, process payments, deliver products, administer accounts and subscriptions, manage returns, product concerns and product-safety reports, and provide customer care.

To operate, secure, analyze, improve and personalize the Services; prevent fraud, reseller activity, promotion abuse and return abuse; protect our brand, intellectual property and authorized distribution; comply with law; and establish, exercise or defend legal claims.

To send brand news or offers that you choose to receive and assess the response to those communications where permitted. Promotional communications and optional advertising technologies are subject to applicable consent and opt-out requirements; ordering a product does not by itself enroll you in marketing.

5. How we disclose information

We disclose information to Shopify and service providers as needed for hosting, payments, delivery, fulfillment, customer care, security, communications and analytics. Access must be appropriate to the service performed and subject to applicable contractual and legal restrictions.

Subject to applicable settings and privacy choices, we also disclose information to Meta through the tools described in Section 7 for advertising measurement, matching and targeting. These disclosures may qualify as sharing or targeted advertising under applicable law.

Shopify Network Intelligence is enabled on our store. Some processing associated with these services may constitute sharing or targeted advertising under applicable state privacy laws. This policy is not consent to optional tracking. Applicable privacy choices are described in Sections 6 and 7. Consumer health data is not used for these purposes.

We may disclose proportionate information to professional advisers, insurers, carriers or suppliers to handle a product, safety or legal matter; to authorities where legally required; in a lawful business transaction such as a merger or asset sale; or at your direction. Identifying or health information is restricted to what is necessary and lawfully permitted.

We do not provide customer personal information to affiliates for their own purposes.

We do not sell personal information for money or sell consumer health data. Certain advertising-related disclosures may nevertheless qualify as a sale, sharing or targeted advertising under applicable state laws and are subject to the applicable notices and choices.

6. Shopify

Our store is hosted by Shopify, which processes information when you browse and make purchases. Shopify Network Intelligence is enabled. Shopify uses information about interactions with our store together with information about interactions with other merchants and Shopify to provide enhanced services, including features that improve services, personalize experiences and support advertising.

Information is shared with Shopify and other service providers, which may be located in the United States or other countries, to provide these services. Shopify also processes information for its own purposes under its Consumer Privacy Policy. You can use Shopify’s Privacy Portal to learn about and exercise choices concerning that processing.

7. Cookies, analytics and privacy choices

Shopify and payment or security services use cookies and similar browser storage for shopping carts, checkout, account sessions, preferences and fraud prevention. Other technologies support analytics and the enhanced services described above.

We use Google Analytics 4 to understand how visitors use our website and assess website performance. Depending on applicable settings and privacy choices, information sent to Google can include page addresses and titles, referral and campaign information, browser and device details, approximate location, client and session identifiers, and shopping interactions. Google processes this information as described at https://policies.google.com/privacy and https://policies.google.com/technologies/partner-sites.

We use Meta Pixel, advanced matching and Conversions API through Shopify’s Facebook & Instagram channel to measure advertising and shopping interactions and help us reach people likely to be interested in our products. Depending on applicable settings and privacy choices, Meta may receive page and product views, search terms, cart additions and removals, checkout and payment-step activity, purchases and order values, and click and browser identifiers. With Enhanced data sharing, Shopify also sends purchase events from its servers to Meta and shares available name, address or location, email address and phone number for matching. Meta processes information under its Privacy Policy: https://www.facebook.com/privacy/policy/.

Browser cookie blocking alone does not necessarily stop server-to-server sharing. Use the consent and opt-out routes below to exercise applicable choices.

We use Shopify privacy controls to communicate applicable consent choices. Where consent is required, optional cookies and tracking are subject to that consent. Consent can be withdrawn through the available privacy controls. Withdrawing consent does not undo processing that has already occurred.

Where available, use the cookie banner or privacy preferences to manage consent, and use Your Privacy Choices (https://fermataritual.com/pages/data-sharing-opt-out) to opt out of applicable sale, sharing or targeted advertising. You may also contact support@fermataritual.com or use Shopify’s Privacy Portal. We honor applicable Global Privacy Control signals and do not impose unnecessary identity verification on opt-out requests. Browser controls can also restrict cookies, although some shopping functions may then be unavailable.

If we introduce additional tools or materially change existing processing, we will update this policy and provide the notices and choices required for that processing.

8. Categories and retention criteria

Category

Examples

Retention criteria

Contact and account information

Name, email, address, account identifiers

For account or service needs; thereafter only for applicable legal, security or transaction-record purposes.

Order and commercial records

Orders, payments, returns, product-concern records

For fulfillment and the applicable tax, accounting and lawful claim-preservation periods.

Technical information

IP address, session or cart identifiers, security logs

For the relevant technical purpose and provider expiry settings; longer only for a specific lawful security or recordkeeping need.

Preferences and marketing choices

Selected preferences, subscription and opt-out records

While needed for the chosen service; minimal suppression records may be kept to respect an opt-out.

Customer-care and safety records

Messages, batch details, photographs, incident reports

For the matter and specifically applicable retention duties; health data also follows Policy 10 and its deletion requirements.

We retain information only for as long as reasonably necessary for the purposes described, considering the transaction, requested service, applicable tax or recordkeeping requirements, security needs and legally permitted claim-preservation periods. Where a fixed period cannot reasonably be specified for a category, the criteria in the table determine the retention period. We delete or de-identify information when it is no longer needed, subject to lawful exceptions. Health-data requests follow the more specific Consumer Health Data Notice; a general reference to legal claims does not create an unlimited retention exception. We do not use sensitive information to infer personal characteristics.

9. Notice of financial incentive

A discount or other benefit for signing up to marketing applies only if expressly offered. The sign-up notice will state the benefit, eligibility, information requested, how to withdraw and any financial-incentive disclosures required by law, including a good-faith value explanation where required. Joining is voluntary and is not a condition of an ordinary purchase. This policy does not itself launch an incentive or assert a valuation of your information. An email sign-up does not authorize marketing texts.

10. Your rights and choices

Depending on your location and the law that applies, you may have rights to access, know, correct, delete or receive a copy of information, obtain information about disclosures, opt out of sale, sharing or targeted advertising, and appeal a decision. Email support@fermataritual.com. We will verify requests only as permitted and proportionate, accept authorized-agent requests where required, explain a denial and provide the applicable appeal route and deadline. A request will be answered within the legally required period. We will not unlawfully discriminate against you for exercising privacy rights. Statutory exceptions apply only to information and purposes they actually cover.

You can unsubscribe from marketing emails using the link in each message. We will still send transactional, account, safety and service messages.

11. Consumer health data

We do not use purchases or browsing to infer a health condition. A support request, product reaction or injury report can nevertheless contain consumer health data, including information you choose to provide about another person. That information is subject to our Consumer Health Data Notice and any applicable consent, use, disclosure and deletion requirements. Please share only what is necessary to handle the matter.

12. Security, international processing and third parties

We use reasonable safeguards appropriate to the information and processing involved. No website or transmission method is completely secure. Keep account credentials confidential and report suspected unauthorized access promptly. This description does not exclude any security, breach-notification or other obligation that applicable law imposes on us.

The Services are intended for users in the United States. Information may be processed in the United States and other countries where our service providers operate. Third-party websites and social platforms are governed by their own notices. Reviews and social posts you make public may be visible to others.

13. Children

The store and account services are directed to adults aged 18 and over. We do not knowingly seek personal information from children through marketing or account registration. If you believe a child has supplied information, contact support@fermataritual.com so we can assess and delete or otherwise handle it as required by applicable law. An adult’s necessary product-safety report about a child is handled under the Consumer Health Data Notice, not used for marketing. Purchasing eligibility is separate from each product’s labeling.

14. Updates and contact

We may update this policy at any time by posting the revised version with a new date. Where required by law, we will provide additional notice or obtain consent.
